Chinese bear bile farming draws charges of cruelty

CHENGDU, China ? It was, at first glance, a rather modest initial public offering by a small Chinese company seeking to expand production of the key ingredient used in traditional remedies said to shrink gallstones, reduce fevers and sooth the aftereffects of excessive drinking.

But Guizhentang Pharmaceutical, the country's largest producer of bear bile extract, apparently overlooked one important factor before submitting its application to the Shenzhen Stock Exchange: China's increasingly audacious animal rights movement.

Guizhentang's proposal to triple the company's stock of captive bears, to 1,200 from 400, provoked a firestorm from those opposed to bear bile farming, a process that involves inserting tubes into the abdomens of bears and "milking" them, sometimes for years.

Protesters in bear suits picketed drugstores, hackers briefly brought down Guizhentang's website and more than 70 Chinese celebrities, including the basketball legend Yao Ming and the pop diva Han Hong, circulated a petition calling on the stock exchange to reject the IPO.

After some of China's biggest news media outlets posted harrowing undercover footage revealing cages so tight the bears could barely move, Guizhentang last month withdrew its application, saying it needed more time to put together its filing.

For China's animal welfare advocates, the victory signaled the growing clout of a movement that is frequently derided as bourgeois, frivolous or worse. Its most vociferous opponents paint animal advocates as foreign-financed traitors who would do away with such hallowed Chinese traditions as dog meat hot pot, ivory carving and dried deer penis.

Deborah Cao, a lawyer who frequently writes about animal rights in China, said campaigns like the one that defeated Guizhentang showed how social media brought together the generation of educated Chinese urbanites who grew up with household pets and anthropomorphic Disney characters. "It's a bottom-up, grass-roots movement, one that is contributing to an emerging civil society increasingly aware of individual rights and obligations, be it to humans or animals," she said.

Such activism is even more notable given the constraints the Communist Party typically imposes on public lobbying, street protests or any unsanctioned organizing.

Advocates have not yet persuaded the government to enact animal welfare legislation. But optimists say they have started to chip away at the long-held notion that animals exist to satisfy the medicinal and gastronomical needs of humans.

Activists point to the growing visibility of public awareness campaigns targeting the consumption of shark fins as well as a recent spate of vigilante attacks that have blocked trucks laden with cats and dogs from reaching the slaughterhouse. In December, the state-run broadcaster CCTV ran a series of exposis highlighting the illegal consumption of monitor lizards, rhesus monkeys, barking deer and other wildlife, and the police crackdown on black market dealers that followed.

"Animal rights activists are walking an incredibly sensitive tightrope, but I think they're reaching a tipping point right now," said Jill Robinson, the director of Animals Asia, an organization based in Hong Kong that has been campaigning for two decades to end bear bile farming.

Still, despite what appears to be growing public opposition to the practice, the Chinese government is not prepared to end the lucrative trade in ursodeoxycholic acid, the active ingredient found in bear gallbladders. Although scientists have engineered a synthetic alternative, traditionalists claim it lacks the therapeutic punch of raw bile, which can sell for as much as $24,000 a kilogram, roughly half the price of gold.

Scientists have scrutinized the health effects of bear bile but have come to no definitive conclusions. But sold in powdered form as capsules, or as a tonic, bile is considered by many to be an elixir of sorts. Bile marketers say it fortifies the liver, reduces flu symptoms and improves eyesight.

Yang Tingying, a vendor at the wholesale Chinese medicine market here in Chengdu, the provincial capital of Sichuan, insisted that bear bile cures all manner of liver ailments, including hepatitis. "It's the best because it's from nature," she said, pulling out a pair of desiccated gall bladders, which are illegal to sell.

To the distress of its opponents, the industry has grown significantly in the 13 years since Chinese officials first pledged to gradually reduce the number of captive bears to 1,500 from 7,000. These days, there are an estimated 20,000 bears on nearly 100 domestic bear farms, an expansion fueled in part by marketing efforts promoting novel uses for bear bile, such as a hangover cure for well-to-do businessmen who engage in nightly carousing.

Besides China, there are bear bile farms in Vietnam, Laos, Myanmar and North Korea.

For animal welfare advocates, the challenge is to convince Chinese consumers that the barbarity of bile farming outweighs the supposed medicinal benefits of natural bile - or that the risks of consuming bile from sick bears pumped with antibiotics are high.

In addition to circulating videos of harvesting practices, organizations like Animals Asia wield a number of secret weapons, including Sun Li, Caesar and Buddha. They are among the 158 rescued bears that roam the group's sanctuary near Chengdu. The center receives school groups, celebrities and Chinese reporters, all of who are invariably smitten with the bears.

Most of the animals came from farms closed by the authorities because they had fewer than 50 bears, a violation of industry rules. The bulk of the animals are Asiatic black bears, a threatened species better known as the moon bear.

Nicola Field, the sanctuary's chief veterinarian, said bears often arrived emaciated, their abdomens riddled with the infections, hernias and tumors that are hallmarks of a extraction process requiring open wounds for thrice-daily milkings.

The bears' teeth are invariably worn down from gnawing on the bars of their cages and their feet are often in pitiful shape because few of the animals have ever walked on the ground. "The catalog of abuse they've endured is appalling," Field said.

The years of pain and confinement are so traumatizing, some of the rescued bears spend endless hours butting their heads against walls or gnawing on their limbs.

Industry supporters have mounted their own pro-bile public relations campaign, stressing China's history of traditional medicine and suggesting that animal rights advocates are doing the bidding of foreign drug companies out to promote Western medicine at the expense of homegrown remedies.

During a news conference last year called to counter critics, Fang Shuting, chairman of the China Association of Traditional Chinese Medicine, suggested that bears enjoy the process, which he likened to turning on a tap. "Natural, easy and without pain," he said. "After they're done, the bears can even play happily outside."

His remarks backfired, producing a torrent of ridicule on social media and refutations from experts who said bear farmers could not possibly let the animals leave their cages. "Bears are smart like dogs and remember pain," said Zhang Xiaohai, who has visited a number of bear farms as an undercover investigator for Animals Asia. "They would never willingly come back to be milked again."

But animal rights activists find hope in the attitudes of young Chinese like Guan Zhiling, who was visiting the sanctuary with her high school classmates. "It's brutal and disrespectful to the bears, and a disgrace to the human race," she said.

Stocks fall on news Fed weighed cutting stimulus

NEW YORK (AP) ? Stocks are closing lower on news that several Federal Reserve policymakers favored cutting back on stimulus programs as early as June if the economy continues to improve.

The release of minutes of the Fed's April 30-May 1 meeting reversed a surge earlier in the day.

The Dow Jones industrial average fell 80 points to 15,307 Wednesday, a loss of 0.5 percent. It had risen 154 points after Fed Chairman Ben Bernanke told Congress it was too early to cut back on the Fed's bond-buying program.

The Standard & Poor's 500 fell 13 points to 1,655, or 0.8 percent. The Nasdaq composite fell 38 points to 3,463, or 1.1 percent.

Three stocks fell for every one that rose on the New York Stock Exchange. Volume was heavy at 4.3 billion shares.

Corpus Christi sees first wind energy cargo exports

May 22 - Having been an active participant in the import of wind energy components from global markets since 2006, with record-breaking volumes in 2012, the Port of Corpus Christi reports that new wind energy market trends have reversed trading patterns in 2013.

Last weekend, wind energy components destined for export markets were loaded at Port Corpus Christi for the first time.

NYK-Hinode's Kuwana loaded 36 Mitsubishi wind blades destined for Japan at the port's cargo dock 9.

The blades were manufactured in Ciudad Ju?rez, Mexico, then staged initially at Mitsubishi's laydown yard located in Santa Teresa, New Mexico, before being trucked from New Mexico to the port to await export.

"The port anticipates additional wind cargo export opportunities within the upcoming months," said John LaRue, executive director, Port Corpus Christi.

With wary eye on the U.S., China courts India

NEW DELHI (Reuters) - Chinese Premier Li Keqiang, smiling and effusive, was out to smooth ruffled feathers in India this week, promising to ease tensions and increase trade between Asia's fastest growing economies in his first trip overseas since taking office.

"China will make your dream come true," Li told a banquet hall filled with Chinese and Indian business executives in the financial capital of Mumbai as he wound up his visit on Tuesday.

China's overtures, which come amid worries in Beijing that it is being encircled by the United States and its allies, however met with a cool response.

India has been shaken by a recent border spat with China and is cautious about Beijing's friendship with rival Pakistan, where Li flies on Wednesday. New Delhi is also concerned about a ballooning trade deficit with China and a flood of cheap Chinese-made goods undercutting local manufacturers.

While India's relations with the United States are cordial and it is a major purchaser of its weapons, New Delhi has stayed away from a close strategic alliance.

"We would not like to see India become a tool of other major countries, especially the U.S., to counterbalance or check or contain China," said Hu Shisheng, an India specialist at CICIR, a Chinese government-backed think tank in Beijing.

"We want, through closer relations, to support New Delhi's policy that maintains equal distance. It's not realistic to expect India to be closer to one country than the other."

Li, who is travelling with executives from 41 Chinese companies, said the two rapidly-growing economies should free up bilateral trade and do more business together, instead of relying on others for development.

"With a long border and extensive common interests, China and India should not seek cooperation from afar while neglecting the partner close by," he said in a speech to businessmen and diplomats earlier on Tuesday.

Chatty and relaxed, Li repeatedly took Prime Minister Manmohan Singh by the hand and said a visit to India 27 years ago influenced him much as exposure to the sub-continent had affected Steve Jobs, the legendary co-founder of Apple.

Singh smiled back, but hardened India's stance on the long-standing territorial dispute between the two nations, saying broader ties could not blossom without peace on the border.

In the past, India has sought to separate the border dispute from wider relations. The difference this time was that Li's visit came just weeks after Chinese troops set up camp 19 km (12 miles) inside territory India claims as its own.

The stand-off, which only ended on May 3 after three weeks of high-level negotiations, caused a public outcry in India. It overshadowed preparations for Li's trip and may explain the lack of significant bilateral agreements signed.

SEVERELY TESTED

Despite the large commercial delegation, only one major business pact was signed, a $1 billion debt-for-fuel deal between China and Essar Energy PLC Lt, part of India's Essar group. Smaller pacts added a total $500 million in deals.

China and India disagree about large areas of their 4,000 km (2,500 mile) border and fought a brief war 50 years ago.

There has not been a shooting incident in decades but the feud prevents normal trade relations between neighbors, who account for 40 percent of the world's population.

Lalit Mansingh, a former Indian foreign secretary, the top official in the external affairs ministry, said he detected a new openness between the leaders of the two countries, and a willingness to tackle thorny issues. But he said the recent border confrontation had severely tested India's patience.

"They don't want us to get closer to the Americans. But ironically, that is exactly what they are doing by being extremely provocative at the border," Mansingh told Reuters, adding that China was also irking neighbors with maritime disputes with Japan and nations in Southeast Asia.

"By picking up a fight with every single neighbor after a period of friendship with all neighbors, the Chinese are, in fact, getting people together in a line up against them."

On the back of this week's visit, both Prime Minister Singh and Premier Li are due to visit each others respective rivals.

Next week, Singh is headed to Japan, which is engaged in an increasingly edgy dispute with China over a group of islets in the seas between them.

Li goes to Pakistan, where he is to sign agreements to develop the Chinese-managed Gwadar port.

India has often been nervous about Chinese agreements with its neighbors that are not strictly military but could be leveraged in a conflict.

Indians sometimes refer to these as a "string of pearls," which include China's ties with Pakistan, access to a Myanmar naval base, Chinese construction of a deepwater port in Hambantota, Sri Lanka, and its deepening ties with Nepal and the Maldives. Its force deployments in Tibet add to India's stress.

In Beijing, there are worries that the country is being encircled by the U.S. strategic pivot to Asia and its allies like Japan, South Korea, Taiwan, the Philippines and more recently, Vietnam. China has also been closely watching the improvement of U.S. ties with Myanmar and India.

TRADE GRIPES

After the border, India's biggest gripe with China is over trade. From almost nothing in the 1990s, bilateral trade hit a peak of $73 billion in 2011, heavily skewed in China's favor.

In comparison, China's annual trade with Japan is close to $300 billion. On Tuesday, Li pitched hard for closer economic cooperation and said Chinese companies could help India rapidly modernize its skeletal infrastructure.

"Our industrial structures are highly complementary, India has a competitive edge in IT, software and bio-medicine, while China is seeing rapid expansion of its machinery, textiles and emerging industries," Li said, and offered talks on a free trade agreement.

But India complains that China does not give its pharmaceutical and IT companies fair market access.

One Indian trade official, speaking to Reuters, burst out laughing at the free trade proposal, saying there was no way India would consider it until the trade imbalance was addressed.

That may take some time.

In a joint statement signed on Monday, China reiterated it would increase access for Indian products. The same was said on a visit by Premier Wen Jiabao in 2010 - but last financial year, India's bilateral trade deficit grew to $41 billion.

Obama to meet Chinese President Xi in June

(Jason Lee/Reuters)President Barack Obama will meet with Chinese President Xi Jinping for the first time on June 7-8 in California, the White House announced on Monday. The talks come amid rising U.S. anger at alleged cyberattacks originating in China and concerns about Beijing?s expanding global influence.

?The two leaders will review progress & challenges in U.S.-China relations & discuss ways to enhance cooperation in the years ahead,? Obama?s National Security Council press staff said on Twitter.

U.S. national security adviser Tom Donilon will travel to Beijing on May 26-28 in advance of the meeting.

Despite tensions over alleged hacking and China's sometimes tense relations with U.S. allies like Japan and South Korea, U.S. officials have praised Beijing's help in the latest confrontation with North Korea. And Obama aides take a largely positive view of China's role in the international effort to get Iran to freeze its suspect nuclear program.

"The United States wants a strong, normal, but special relationship with China, and that?s a special?because China is a great power with a great ability to affect events in the world. And we need to work together," Secretary of State John Kerry said during a mid-April trip to Beijing. Kerry's comments raised some eyebrows, because the term "special relationship" is typically reserved for America's ties to Britain.

The leaders will meet at Sunnylands, the Walter and Leonore Annenberg estate. On its website, it bills itself as "a West Coast 'Camp David,' where global leaders seek to advance international agreement.?

STOCKHOLM (AP) ? Sweden became the first home team to win the world hockey championships in 27 years, beating Switzerland 5-1 on Sunday for its ninth title.

Vancouver Canucks star Henrik Sedin had two goals and an assist, and Buffalo Sabres goalie Jhonas Enroth made 26 saves to help Sweden become the first team to win the title on home ice since the Soviet Union in 1986. Switzerland earned its first medal in 60 years.

Simon Hjalmarrson, Philadelphia's Erik Gustafsson and Dallas' Loui Eriksson also scored for Sweden. Romas Josi had the lone goal for Switzerland.

The Tortoise and the Hare in Real Estate Investing | Dornish Law ...

In over twenty years of working with real estate investors, and being personally involved in real estate investing for even longer, I have had the opportunity to weigh the advantages and disadvantages of different types of real estate investing.???? That review has led me to the almost perfect analogy to the old fable of the Tortoise and the Hare.

For those too young to remember the old fables, the hare challenged the tortoise to a race believing it was a sure thing the hare would win.? The hare sprinted from the gate at great speed, recognized that he was immediately far ahead of the tortoise, who carried his home on his back as he steadily advanced on the race course.? The hare became comfortable with the size of the lead and stopped to pursue other interests.? The tortoise remained on track steadily moving towards his objective.? In the end, the tortoise crossed the finish line first, much to the surprise of the hare.

I see the almost perfect analogy to real estate investors who focus on flipping or quick turn properties as the hares, and investors who focus on long term holding of rental property as the tortoises.? Flipping properties requires a burst of energy and commitment at the beginning and, indeed, for each project thereafter, and returns in a relatively short period of time between the purchase and the sale, a profit, directly measuring the success of the investment.

In contrast, while buying and renovating long term investment properties requires a similar upfront commitment and energy, the reward for that activity is not quickly realized.? The long term investor does not realize the entire value of the improved real estate by cashing out quickly after the improvements are made.? Rather, the investor retains the asset and simply gets a return on the value of that asset, much of which is diverted to paying down the investor?s mortgage on the property. ?The investor?s monthly increase in available cash is only a small fraction of the cash realized by the flipping, wholesaling or quick turn real estate investor.?

However, the long term investor realizes a large number of benefits from his or her investment activities over the entire time he or she holds the property.? First, there is of course the increase in cash flow from the rent received from the property.? Second, there is the increase in net worth which accrues each month in the amount of the principal paid down on the financing of the property.? Third, there is any appreciation of the value of the property during the period in which the property is held by the investor.? Fourth, there is the availability of depreciation to offset and defer tax liability on other income of the investor.? Fifth, there is the increase in cash flow which comes from the increase in the rental value of the property, roughly keeping up with inflation.? Of course, once the mortgage is paid off, there is a dramatic increase in cash flow and value which I call the ?retirement plan effect? of long term holdings.

For younger investors, this can be accomplished even with financing extending over twenty years or more.? For older investors, a shorter mortgage term is required to reach more quickly the dramatic increase in value and cash flow.? Often, current cash flow can be sacrificed to shorten the mortgage term and increase retirement age cash flow.

Finally, with the mortgage paid off the property is an asset which appreciates roughly to keep pace with inflation and provides a ready source of capital through refinancing or sale to cover more substantial financial needs later in life.? Upon the investor?s demise, the remaining equity value in his or her properties becomes available to heirs as part of the investor?s estate.? Substantial assets can obviate the need for life insurance to pay obligations and can provide a supplemental retirement income for a spouse or can be available to cover the cost of long term health care.? Unless our tax structure changes, a long term capital gain, including the recapture of any depreciation, can be realized on the sale of the investment property, subject to advantageous capital gains tax rates rather than the highest marginal tax rate of the investor.? Further, if depreciated property is passed to heirs in the real estate investor?s estate plan, the heirs receive a step up in basis to the date-of-death value of the property, and do not pay capital gain tax based upon the depreciated basis held by the deceased.

As you can see, none of the myriad of benefits which accrue to the long term real estate investor are available to the flipping, quick turn or wholesaling real estate investor.? Flipping properties is a ?sexier? investment with a quicker return, but the value of that investment is simply limited to a one-time return.

As I write this article, I have in mind two ACRE members who have been real estate investors for over twenty-five years.? One has remained an active flipping and wholesaling investor, quit his ?day job? years ago and has enjoyed a life style which he has been able to achieve from those transactions.? His income has ebbed and flowed in direct relation to the ease of credit available to his back end buyers, and over the years he has shifted from doing most of the construction work himself on his flips to hiring others and supervising their work as age has limited his physical stamina.

The other investor used front end flips, lived in properties during renovation to cut costs, and borrowed money from a wide range of sources to begin to grow a long term portfolio of real estate.? That investor lived a tight financial existence for the early years of his career, but became more and more financially secure and comfortable as time went by.? His many rental units paid for themselves, he built his equity, and for years now, he has enjoyed the financial benefits of a long term investing strategy.? He has a large number of possessions including Florida real estate, high end vehicles and jewelry and pays other people well to maintain and manage his various investment properties, while he himself works fewer hours and significantly less physically than the first investor.? The second investor?s most pressing problems are minimizing his income taxes and maximizing the benefit of his estate plan, while providing for several generations of his family a comfortable living.

The second investor doesn?t have to worry about where he will find his next good deal on a flip, or about who will be available to do the renovations or to buy the property when it is fully renovated.? He doesn?t have to worry about carrying life insurance or long term care insurance because his assets are more than sufficient to cover those concerns and still provide a comfortable inheritance for his family.

To return to the fable of the Tortoise and the Hare, I believe the second investor, the tortoise, has already won the race.? Don?t you agree?

If at first you don't succeed? Well, that might be a little misleading. Nokia's Lumia 920?for AT&T has been modestly successful as far as Windows phones are concerned. But Nokia is trying again with the $99.99 Lumia 928 for Verizon Wireless. It's almost the exact same phone?as the 920, except it's been fitted with a new, lighter design, and improved low-light camera performance. The Lumia 920 was arguably the best Windows phone on the market, so there's no doubt the Lumia 928 now holds the title. It's a well-priced alternative to Android and Apple, but it's still not the best phone on Verizon.

Design and Call Quality
If the Lumia 920 is flat-out humongous, then the Lumia 928 is just really big. Whereas the 920 weighs in at a whopping 6.53 ounces, the 928 is somewhat more reasonable at 5.71 ounces. That's still a lot heavier than the 4.6-ounce Samsung Galaxy S 4?which is not only lighter, but has a much bigger screen than the Lumia 928. And it's nearly two full ounces heavier than Apple's 4-ounce iPhone 5, though that phone has a smaller screen. But there's no way around it?the Lumia 928 is a big phone. At 5.24 by 2.71 by 0.44 inches (HWD), you can still hold and operate it with just one hand, but there's a lot of excess bezel around the display at every angle.

Nokia has traded the matte polycarbonate of the Lumia 920 for a high-gloss finish. I miss the matte, which has a much more sumptuous, luxe feel. But I especially miss all of the fun colors, like red, blue, and yellow. The Lumia 928 is only available in black or white.

The rolled edges of the 920 have been replaced with much sharper angles?you can even stand the 928 up vertically if you choose to do so. The headphone jack is at the top left of the phone, while the micro USB jack is next to it in the center. On the right side you'll find Volume, Power, and Camera buttons. I would've preferred the buttons be broken up differently, as I kept pressing the Volume button when I meant to press Power. There's no memory card slot, and the 2,000mAh battery is sealed in. I got 9 hours and 32 minutes of talk time, which is very close to what we saw on the Lumia 920, which has the same battery. Also like the 920, the 928 has features wireless charging, but you need to purchase a separate (wired) charging pad in order to use it.

The Lumia 920's 4.5-inch IPS LCD has been replaced by a 4.5-inch OLED panel. It has the same 1,280-by-768-pixel resolution, and the same 334-pixels-per-inch screen density. The main difference is that OLED looks even richer, though I don't dig the PenTile pixel layout, which can cause text and images to appear fuzzy if you look closely. But the phone is much more readable outside than many of its competitors.

The Lumia 928 supports a ton of frequency bands, so you can connect to global HSPA+ and LTE networks if Verizon has roaming agreements with those carriers. The phone also has 802.11 a/b/g/n Wi-Fi on the 2.4GHz and faster 5GHz bands, along with Bluetooth 3.0, GPS, and NFC. Reception was decent and 4G LTE data speeds in Manhattan were on par with what we've been seeing lately.

This is a great phone if you like to talk. Incoming calls get very loud and sound clear, with a real richness and warmth. The same goes for calls made with the phone, which were easy to hear even when made from an area with lots of construction noise in the background. The speakerphone is borderline loud enough to hear outside, and calls sounded great over a Jawbone Era?Bluetooth headset. I had no trouble triggering Microsoft's voice command software, which works fine for making calls, but is no match for Apple's Siri.

Windows Phone 8 and Apps
The Lumia 928 uses the same 1.5GHz dual-core Qualcomm Snapdragon S4 Plus MSM8960 processor as the 920, not to mention the Lumia 822, the HTC 8X, and the Samsung Ativ Odyssey. In short, there isn't much variation among any of the Windows phones. That's mostly thanks to Microsoft, which runs a much tighter ship with Windows Phone than Google does with its open-source Android. That's good for quality assurance, but bad for innovation. Either way, benchmark scores on this phone were on par with other WP8 devices.

Windows Phone 8 is a quick, minimalist operating system built around a series of live tiles on your home screen. The tiles continuously pull information from social networks, the Internet, messages, and local content stored on your phone, which is both useful and fun. Of particular note is the People Hub,?which pulls together your contacts from different sources?like email, Facebook, and Twitter?and presents you with all of your social-networking updates in one place.?It's more flexible than Apple's iOS, but less than Google's Android. The biggest difference among Windows phones lies in the included apps, which is where Nokia once had a leg up on the competition. When the Lumia 920 came out, most of Nokia's proprietary apps were exclusive to Nokia Phones. Now Nokia is serving up those apps for all WP8 phones in the Windows Phone store, though they come preloaded on the 928. Nokia is doing this in order to acquire more user-generated data for a better overall experience, though it claims the apps themselves work best on Lumia devices.

Senate committee moves toward vote on immigration

WASHINGTON (AP) ? The Senate Judiciary Committee is aiming this week to pass a landmark immigration bill to secure the border and offer citizenship to millions, setting up a high-stakes debate on the Senate floor.

First, the committee must resolve a few remaining disputes.

One involves amendments over high-skilled immigrant visas sought by the high-tech industry but opposed by labor unions. The bill as written increases the availability of these visas, but includes restrictions aimed at ensuring U.S. workers get the first crack at jobs. Silicon Valley companies view some of the restrictions as too onerous and are lobbying to soften them.

Sen. Orrin Hatch, R-Utah, seen as a swing vote on the committee, is on the side of the high-tech industry, while Sen. Dick Durbin, D-Ill., is championing the labor position. Lawmakers and lobbyists have been trying to find a compromise that could win Hatch's support for the overall bill without alienating Durbin, one of its authors.

There's also a disagreement over whether gay Americans should be given the right to sponsor their foreign-born spouses for green cards like straight Americans can. Gay rights groups are pressuring Judiciary Chairman Patrick Leahy, D-Vt., to offer an amendment allowing this, but Republican authors of the immigration bill insist that they'll abandon their support for their legislation if such a measure is included.

Both disputes were put off until last week as lawmakers negotiated behind the scenes and weighed their options. The three public work sessions the Judiciary Committee held over the last two weeks featured little suspense, as committee members waded through some of the 300 amendments that were filed to the bipartisan bill. The legislation seeks to dramatically remake the U.S. immigration system and allow tens of thousands of new high- and low-skilled workers into the country.

Committee members accepted a number of Republican-sought changes to the bill, including provisions tightening up border security. But majority Democrats and the two Republican committee members who helped write the legislation ? Arizona Sen. Jeff Flake and South Carolina Sen. Lindsey Graham ? fended off major changes, branded "poison pills," that could jeopardize the delicate compromises at its core.

This week, in addition to the high-tech and gay marriage disputes, amendments will focus on the crucial sections of the bill dealing with the 13-year path to citizenship the legislation offers the 11 million people in this country who are here illegally.

Democrats have the votes to ensure committee passage of the legislation by the end of the week, before Congress breaks for its Memorial Day recess. The outcome is less certain on the Senate floor, where Majority Leader Harry Reid, D-Nev., has promised the measure will be considered in June. Less certain still is the outcome in the GOP-controlled House, where Speaker John Boehner, R-Ohio, has not said publicly how or when he'll proceed with bringing immigration legislation to a vote.

Education Minister Hekia Parata has today announced the next phase of consultation on transforming the New Zealand Teachers Council into a professional body fit for the 21st Century.

Ms Parata has released the New Zealand Teachers Council review report together with a discussion document proposing the establishment of a new professional body for teaching and education leadership.

?A skilled, ethical, well researched and well led education profession is vital for New Zealand?s future. Educational success does not happen without great teachers and leaders and both require our best and brightest people, and all deserve a strong professional body to support them,?? says Ms Parata.

?It is in the interests of all New Zealanders that we have a strong and universally respected education profession that delivers the values, skills and knowledge that our children and young people need to be successful in the 21st century economy and society.?

The Government has a critical interest in ensuring that all young New Zealanders are getting the best education possible.

?Achieving this is not something the Government can or should do alone. We need the education profession with all the knowledge, expertise, and professional capabilities it can bring to the development of the highest quality teaching, and the highest quality education leadership.??

The Teachers Council Review Committee took into account 177 submissions, interviews with individuals and groups from throughout the education sector, considered New Zealand and international research, and looked at similar professional bodies in the health, legal, and engineering sectors.

It made 24 recommendations which fall into four key themes: a new professional body, the regulatory framework for teachers, the disciplinary framework, and resourcing to support a strong, professional body.

In addition, the Ministerial Cross Sector Forum on Raising Achievement made recommendations about strengthening the quality of education leadership in early childhood centres and schools.

The Government has appointed a Ministerial Advisory Group to lead consultation with the sector and the public on the proposals over the next two months.
The Group will be headed by Dr Graham Stoop and is made up of eight other educational leaders.

?I?m delighted Dr Stoop has agreed to be seconded to the Ministry of Education from his duties as Chief Executive of the Education Review Office to chair this group.
?His experience and standing in the education sector will be hugely valuable.??

One of the key findings in the review was that the Council ?as it is currently structured, governed and positioned, can?t effectively set and enforce standards for entry, progression and professional accountability with the full support of the profession. It lacks a distinctive brand or effective public voice.??

?The Government will work with the sector to transform the Council into a professional body for the 21st Century, geared to support a well led professional workforce that is skilled, flexible and culturally intelligent.

?My vision is for a strong New Zealand professional body that provides leadership and is owned and driven by the education profession. The proposed new body would drive changes to improve the quality of teaching and education leadership, and ensure robust processes are in place to protect children.??

The review made a number of recommendations on a new regulatory framework. It recommended clearer separation between becoming registered as a teacher and the issuing of practising certificates, which certify the ongoing competence of teachers.

It also recommended that in addition to the current Limited Authority to Teach, a broader Authority to Educate is introduced to allow individuals with proven expertise to complement the teaching workforce.

The review also endorsed a move to post graduate entry to the profession for school teachers.

?We know the most important thing we can do to raise achievement is to raise teaching and leadership quality throughout the whole education system,?? says Ms Parata.

?This is a priority for our Government. That?s why in Budget 2013 we announced we are investing $37.5 million over four years to lift the quality of teaching and leadership. This is on top of $352 million we are already planning to spend on professional learning and development for our education profession over the next four years.

?As the review found, to improve outcomes for all students and to address equity issues, New Zealand must have a flexible, skilled and culturally intelligent and well-led workforce.?

The review of the New Zealand Teachers Council was instigated in 2010 following recommendations from the Workforce Advisory Group?s report: A Vision for the Teaching Profession. The Government made a commitment to carry this work through in 2011.

The review started in July and took into account the findings of the Ministerial Report into the Employment of a Convicted Sex Offender in the Education Sector.

The review committee comprised Pauline Winter (chair), Dr Judith Aitken, John Morris, and Robyn Baker.

The New Zealand Teachers Council was established in 1989 following the disestablishment of the Teacher Registration Board. It currently regulates over 100,000 registered teachers across the schools and early education sectors. Most of these (70 per cent) are fully registered with the remaining 30 per cent some way towards full registration.

Yahoo: Rough and Tumblr | The Economist

AT A recent conference, Ken Goldman, the chief financial officer of Yahoo, admitted that the internet giant had an ageing audience and was looking for things to ?make us cool again?. The firm's senior executives appear to think Tumblr can give it a shot at rejuvenation. According to various media reports, Yahoo is likely to announce tomorrow that it is paying $1.1 billion for the popular blogging service. (Editor's update (May 20th, 12pm GMT): Yahoo announced the deal on Monday morning.) Other companies like Facebook are said to be interested in Tumblr, but Yahoo is thought to be the preferred bidder.

It is not hard to see why Tumblr has attracted the internet giant's attention. The business, which was launched in 2007, is?hugely popular and many of the service?s users are young folk who like to share everything from their latest fashion tips to pictures of cats with their heads encased in bread (yes, really). Tumblr has grown rapidly and now has some 117m unique monthly users according to ComScore, a research firm. It manages 108m blogs and hosts 51 billion posts.

Tumblr?s sizeable audience appeals to Marissa Mayer, the boss of Yahoo, who took over the reins at the internet firm last year. Her brief has been to try and turn around a company whose share of the online advertising market is being rapidly eroded by the likes of Facebook and Google. In the first quarter of 2013 Yahoo?s revenue shrank 11%, to $1.1 billion.

In a bid to reignite growth Ms Mayer has spruced up some of Yahoo?s ageing products, including Flickr, a popular photo-sharing service, and has taken the company on an acquisition spree. In March, for instance, the company forked out $30m for Summly, a company founded by a 17 year-old that makes apps that summarise news stories. And more recently it courted Dailymotion, a French video site, only to back away when the French government kicked up a fuss about an American firm acquiring one of the country?s start-up crown jewels.

The common thread here is Ms Mayer?s firm belief that Yahoo needs to make headway in new areas such as mobile services and online video if it is to prosper. The firm has also been looking at social networks and other online-sharing services, which has brought it to Tumblr. The big question is whether it makes sense to fork out a whopping $1.1 billion for a company that is said to have made?just $13m of revenue last year.

Among other things, Yahoo will probably argue that it can speed up Tumblr's expansion by promoting it to Yahoo's 700m unique monthly users. It will also point out that it has the know-how and resources to help the blogging service mint money from online advertising. And it may drop hints that Tumblr executives can help it rethink other areas of its business to make them more social.

Critics have been quick to point out that advertisers are unlikely to want their ads to appear alongside some of Tumblr?s content, notably numerous blogs that feature pornographic content. They have also been pointing out that a big part of Tumblr?s appeal is that its bosses have not let the service become overrun with advertising. If Yahoo starts to pump in huge numbers of ads, people may abandon the service in droves.

True, but if Yahoo manages the acquisition carefully it could turn out to be a smart move. Plenty of folk predicted a mass exodus from Instagram, a photo-sharing service, after Facebook snapped it up for $1 billion last year. But the social network has managed to develop the service without making users head for the exit. If Yahoo can pull off a similar feat with Tumblr, then it will certainly appear cooler to its shareholders.

Video shows kidnapped Egyptian security officers

CAIRO (AP) ? Seven men purported to be the members of Egypt's security forces kidnapped by suspected militants last week appeared in a video posted online Sunday and urged the government to secure their release by meeting their captors' demands.

The video, posted on YouTube, is the first sign of the six policemen and one border guard since they were abducted by gunmen on the road from the Sinai Peninsula to Cairo on Thursday. Egyptian security officials said they believed the men in the clip were the missing personnel and that authorities were treating the matter seriously. The father of one of the captives identified his son in the video.

The kidnappings have embarrassed President Mohammed Morsi's government, and are seen as a test of his administration's ability to restore security to the volatile peninsula. They also have renewed a national debate on how best to tackle the troubles in northern Sinai, which borders Gaza and Israel. While many called for a swift security response, some argued that such a move would spark a backlash.

Authorities have been in contact with the kidnappers through mediators. The kidnappers have demanded the release of several militants held in Egyptian jails, including some convicted during Mubarak's rule, officials say.

In a statement Sunday, the president said that there is "no room for dialogue with the criminals" responsible for the kidnappings. The statement followed a meeting Morsi held with politicians from largely Islamist groups to brief them on efforts to secure the captives' release.

The president wrote on the social media website Twitter Sunday evening that "all options are on the table" to free the men and that the government will "not succumb to blackmail."

Sinai has been wracked by lawlessness since the 2011 uprising that ousted longtime leader Hosni Mubarak. Criminal gangs, militants and local tribesmen disgruntled with what they say is state-sponsored discrimination have exploited the security vacuum to smuggle weapons, attack security forces and kidnap tourists to trade for relatives held in Egyptian jails.

In the video released Sunday, the men, blindfolded and holding their hands on their heads, introduce themselves one by one.

One of the men identified himself as Cpl. Ibrahim Sobhi Ibrahim and asked Egypt's leaders to free jailed Sinai militants.

"The demands of the brothers, Mr. President, is the release of political prisoners from Sinai," he says. "Please, Mr. President, release them quickly. We can no longer tolerate torture."

The video closes with the men pleading to the camera: "Rescue us, Mr. President. We can't take it. Rescue us, people." At one point, the tip of a rifle appears over the head of some of the captives, before it is swiftly pulled back off the screen. There were no visible signs of torture on the young men.

It was not immediately clear who posted the video, which was uploaded to a YouTube account created Sunday. Later YouTube took it down, saying it violated its policy on violence.

An Egyptian security official identified the captives in the video as the missing personnel. He said a copy of the video was sent to security agencies, but it was not immediately clear by whom. Another security official in Cairo said families and friends of the captives were called in to identify their relatives.

Both officials spoke on condition of anonymity because they were not authorized to brief reporters.

The names of five of the missing also correspond with names previously obtained by The Associated Press.

Security officials say they believe the assailants carried out the kidnapping after being angered over reports that a prisoner, Ahmed Abu Sheta, had been tortured while in jail. Abu Shehata was convicted of attacking a police station in 2011 that killed police officers.

After meeting Morsi on Sunday, Younes Makhyoun, a leading member of the ultraconservative Islamist Salafi al-Nour party, said the president is eager to avoid a security response.

"Even though there are voices who are demanding security interference and decisiveness, (Morsi) said he wants to rescue the soldiers peacefully, and is keeping the engagement with local tribesmen," Makhyoun told The Associated Press. "The security solution would be easiest, but he wants to save lives."

Makhyoun said his party is also against a security solution because it would lead to bloodshed and won't resolve the problem ? a lingering feeling of injustice by many of those who were convicted and arrested during the Mubarak era. He said the kidnappers' demands include the release of as many as 600 prisoners, some of whom were convicted before 2011. A way out, he said, would be to offer retrials for those convicted in the past or in haste.

Mohammed Abdel-Hamid, the father of one of the policemen, told the private Al-Youm TV station that his son was in the video. He said he would rather see his son dead than have his release negotiated.

Expressing their anger at the recent kidnapping, scores of policemen blocked a commercial border crossing with Israel Sunday to protest the abduction of their colleagues. The policemen closed the main gates of the Awja crossing with chains, leaving around 40 trucks stranded, according to local official Ahmed Osman.

On Friday, policemen blocked a border crossing into Gaza. There was no indication that either Israel or the Palestinians were involved in the kidnapping.

Oldest evidence of split between Old World monkeys and apes: Primate fossils are 25 million years old

May 15, 2013 ? Two fossil discoveries from the East African Rift reveal new information about the evolution of primates, according to a study published online in Nature this week led by Ohio University scientists.

The team's findings document the oldest fossils of two major groups of primates: the group that today includes apes and humans (hominoids), and the group that includes Old World monkeys such as baboons and macaques (cercopithecoids).

Geological analyses of the study site indicate that the finds are 25 million years old, significantly older than fossils previously documented for either of the two groups.

Both primates are new to science, and were collected from a single fossil site in the Rukwa Rift Basin of Tanzania. Rukwapithecus fleaglei is an early hominoid represented by a mandible preserving several teeth. Nsungwepithecus gunnelli is an early cercopithecoid represented by a tooth and jaw fragment.

The primates lived during the Oligocene epoch, which lasted from 34 to 23 million years ago. For the first time, the study documents that the two lineages were already evolving separately during this geological period.

"The late Oligocene is among the least sampled intervals in primate evolutionary history, and the Rukwa field area provides a first glimpse of the animals that were alive at that time from Africa south of the equator," said Nancy Stevens, an associate professor of paleontology in Ohio University's Heritage College of Osteopathic Medicine who leads the paleontological team.

Documenting the early evolutionary history of these groups has been elusive, as there are few fossil-bearing deposits of the appropriate age, Stevens explained. Using an approach that dated multiple minerals contained within the rocks, team geologists could determine a precise age for the specimens.

"The rift setting provides an advantage in that it preserves datable materials together with these important primate fossils," said lead geologist Eric Roberts of James Cook University in Australia.

Prior to these finds, the oldest fossil representatives of the hominoid and cercopithecoid lineages were recorded from the early Miocene, at sites dating millions of years younger.

The new discoveries are particularly important for helping to reconcile a long-standing disagreement between divergence time estimates derived from analyses of DNA sequences from living primates and those suggested by the primate fossil record, Stevens said. Studies of clock-like mutations in primate DNA have indicated that the split between apes and Old

World monkeys occurred between 30 million and 25 million years ago.

"Fossils from the Rukwa Rift Basin in southwestern Tanzania provide the first real test of the hypothesis that these groups diverged so early, by revealing a novel glimpse into this late Oligocene terrestrial ecosystem," Stevens said.

The new fossils are the first primate discoveries from this precise location within the Rukwa deposits, and two of only a handful of known primate species from the entire late Oligocene, globally.

The scientists scanned the specimens in the Ohio University's MicroCT scanner, allowing them to create detailed 3-dimensional reconstructions of the ancient specimens that were used for comparisons with other fossils.

"This is another great example that underscores how modern imaging and computational approaches allow us to address more refined questions about vertebrate evolutionary history," said Patrick O'Connor, co-author and professor of anatomy in Ohio University's Heritage College of Osteopathic Medicine.

In addition to the new primates, Rukwa field sites have produced several other fossil vertebrate and invertebrate species new to science. The late Oligocene interval is interesting because it provides a final snapshot of the unique species inhabiting Africa prior to large-scale faunal exchange with Eurasia that occurred later in the Cenozoic Era, Stevens said.

A key aspect of the Rukwa Rift Basin project is the interdisciplinary nature of the research team, with paleontologists and geologists working together to reconstruct vertebrate evolutionary history in the context of the developing East African Rift System.

"Since its inception this project has employed a multifaceted approach for addressing a series of large-scale biological and geological questions centered on the East African Rift System in Tanzania," O'Connor said.

The team's research, funded by the U.S. National Science Foundation, the Leakey Foundation and the National Geographic Society, underscores the integration of paleontological and geological approaches that are essential for addressing complex issues in vertebrate evolutionary history, the scientists noted.

BlackBerry Q10 Sales

We have seen mixed reports regarding BlackBerry?s performance with the BlackBerry Q10, its first QWERTY toting BlackBerry 10 smartphone. Most industry watchers seems to think early Q10 sales have been strong, though a few analysts have strayed from the pack. RBC Capital Markets? Mark Sue is in the first camp, though he noted in a new research note on Monday Q10 sales might not blow us away. Regardless, however, the analyst says BlackBerry has already succeeded in one respect:?The Q10 is buying BlackBerry some time to turn things around.

?BlackBerry is filling depleted channels, with the company on pace to meet our May-qtr estimates,? Sue wrote in a note to clients sent Monday. ?Competition remains fierce and Samsung?s GS4 is emerging as the flagship push by carriers, though Q10 seems to be settling into a niche for professionals. Expect message of positive turnaround at this week?s user conference.?

The analyst says Q10 sell-through in the U.K. is still ?healthy,? though momentum has slowed following a big launch. Sue noted that less than 5% of the stores he contacted in the U.K. and Canada were sold out of the Q10, but whether or not the phone winds up being a huge success, BlackBerry has already bought itself some much-needed time.

?BB10 channel fill and expected enterprise uptake give BlackBerry time to re-build its business and develop new enterprise and consumer services to offset the shift away from its mandatory services model,? Sue wrote. ?Improving margins, increasing retained earnings and strengthening the balance sheet may enable BlackBerry to carve a niche in the expanding smartphone market.?

Sue reiterated his?Sector Perform rating on BlackBerry shares with an $18 price target.

Secretary of State Matthew Dunlap reminds all business and nonprofit entities on file with the Secretary of State?s office as of December 31, 2012, their 2013 Annual Reports are due June 3, 2013.

Business and nonprofit entities can file quickly and easily using the Secretary of State?s online filing system. To file online, go to https://www10.informe.org/aro/index_on.html . Payment may be made by Visa, MasterCard, Discover, electronic check or with a subscriber account.

The Annual Report fee is $85 for domestic business entities, $150 for foreign business entities and $35 for domestic or foreign nonprofit corporations. Entities that filed online in a previous year will be able to review the information provided at that time, and will simply need to update that information as necessary prior to filing this year?s report. For account subscribers, the online filing service includes additional functionality to assist with managing multiple annual report filings.

Another online service allows noncommercial clerks or noncommercial registered agents to change their addresses. Additionally, this service allows an authorized individual of a foreign entity (organized outside Maine) to change the principal or home office address. Anyone wishing to make these address changes separately from the online annual report filing service, should visit: https://www10.informe.org/icrs/change/ .

For entities that prefer to file a paper annual report, a preprinted form can be downloaded at: http://www10.informe.org/aro/form_download.html .

A substantial late-filing penalty will be assessed, and may not be waived, on all reports received after June 3, 2013, the legal filing deadline.

'Spirit of the Cold War': Russia says US diplomat was ... - World News

Ryan Fogle, a 29-year-old U.S. Embassy employee, was reportedly caught trying to recruit a Russian intelligence official to work for the CIA. ?NBC's Andrea Mitchell reports.

Evoking the spy games of the Cold War, Russia said Tuesday that it had detained an American diplomat who was carrying cash, two wigs and technical equipment and was trying to recruit a Russian intelligence official to work for the CIA.

Russia ordered the expulsion of the American diplomat, whom it identified as Ryan Christopher Fogle, third secretary of the political division of the U.S. Embassy. The State Department said only that an officer at the U.S. Embassy in Moscow had been detained and released.

American officials said they did not expect a rift in U.S.-Russian relations. U.S. officials are trying to improve those relations, and to persuade Russia to help resolve a civil war in Syria.

Wigs and spy gadgets that the Russian Federal Security Service says were carried by American diplomat Ryan Fogle.

Russia used stronger language, calling the matter provocative and in the spirit of the Cold War.

A statement by the Russian Federal Security Service, the successor agency to the Soviet-era KGB, said that Fogle was taken to the service?s headquarters and then to the U.S. embassy after his arrest Monday night.

The security service, known as the FSB, released to Russian media photographs of the American?s arrest and what it said were items he had with him, including the wigs, a torch, a compass and a wad of 500-euro notes, each worth $650.

Russian television also displayed a letter it said was found on Fogle, printed in Russian and addressed ?Dear friend.? The letter offered a $100,000 payment as ?an advance from someone who has been highly impressed by your professionalism, and who would highly value your cooperation in the future.?

The statement from the security service said that the U.S. had ?repeatedly attempted to recruit employees of Russian law enforcement bodies and special departments? recently.

The U.S. ambassador to Russia, Michael McFaul, was participating in a question-and-answer session on Twitter when the detention was announced. He was summoned to Russia?s foreign ministry, The Associated Press reported.

Experts expressed surprise at the old-school nature of the alleged espionage, but they noted that intelligence-gathering had not stopped just because the Cold War ended more than two decades ago.

?If anything, it has increased,? said James Nixey, head of the Russia and Eurasia Programme at the British think tank Chatham House. ?The methods have changed ? or so we thought ? because it?s more about industrial espionage and corruption these days.?

Besides the diplomacy over Syria, there have been questions about whether Russia gave the United States enough information about Tamerlan Tsarnaev, one of the suspects in the attack on the Boston Marathon.

Russian officials asked the U.S. for more information about Tsarnaev, who was born in what is now Russia and traveled to Russia early last year. Russia suspected that Tsarnaev was becoming radicalized, American officials have said.

The FBI interviewed him in 2011 and turned up nothing, and when the FBI asked Russia twice for more information about its concern, Russia failed to respond, the American officials said. Tsarnaev was killed April 19 in a shootout with police.

President Barack Obama later said Russia had cooperated since the attack but noted: ?Old habits die hard. There are still suspicions sometimes between our intelligence and law enforcement agencies that date back 10, 20, 30 years, back to the Cold War.?

The incident would not be the only intelligence blunder in Russia. Britain admitted bugging a Moscow park in 2006 by disguising a recording device as a big rock. The FSB saw a British diplomat picking it up and walking away with it.

Just 14% of businesses say their CMS gives a complete view of ...

Two of the major digital trends of 2013 have been content and inbound marketing, both of which rely to an extent on having an effective content management system (CMS).

New research from Econsultancy and Adobe shows that although organisations are very aware that their ability to implement an effective content strategy is tied to the integration of their CMS with the other technologies, the promise of the technology far outstrips their current reality.

The data shows that 94% of businesses believe that it?s ?quite? or ?very important? to tie content management together with the ability to measure its performance on site (i.e. web / mobile analytics).

Digital asset management (91%) and personalisation (88%) are also seen as key areas that need to be integrated with the business? CMS.

But despite these results, only 14% of responding businesses say that their ?CMS enables them to have a complete view of engagement across all channels.?

The new Econsultancy/Adobe Quarterly Digital Intelligence Briefing, entitled ?From Content Management to Customer Experience Management?, is based on a web content management survey of more than 1,000 business professionals spanning marketing, web development and other business departments, carried out in March 2013.

How important is seamless integration of CMS with the following types of digital marketing platforms or technology?

The survey also asked respondents to rate the ability of their current CMS to integrate with various platforms and technologies.

No one area stands out as a strength, with only web/mobile analytics breaking the 10% mark for ?excellent" ratings. On average, fewer than 30% of respondent organisations describe their integrations as being ?good? or ?excellent,? which is exceeded by those describing them as ?poor.?

How do you rate the ability of your current CMS to integrate with the following digital platforms and technologies?

Looking at which factors present the greatest barriers to successfully implementing a CMS, the most common reasons among business respondents were ?CMS technology limitations? (36%) and ?lack of integration with the rest of the business? (35%).

Conversely, the most common answer among agency respondents was ?poor alignment with business needs? (38%).
